Terms of Service

These terms are an agreement between you and Eiwa. They govern your use of the Eiwa for Beauty Pros service in the United States. Please read them before using the Service.

1. Agreement to These Terms

By creating an account or using Eiwa for Beauty Pros (the "Service"), you agree to these Terms of Service (the "Terms") and to our Privacy Policy and Acceptable Use Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you are 18 or older and that you are using the Service for your own business purposes as a beauty professional or a similar independent professional.

3. The Service

Eiwa is a voice-first AI assistant for independent beauty professionals. The Service lets you manage your work by voice and text, including:

  • Creating and managing appointments through voice commands.
  • Keeping client records, such as names, phone numbers, and appointment notes.
  • Sending appointment reminders and confirmations to your clients.
  • Answering questions about your schedule and client history.

The Service is available through a Telegram bot and an Android application. Features may differ between platforms and may change as the Service evolves.

4. Free Private Beta

The Service is currently offered as a free private beta. Access is granted by invite code or through accounts that we approve manually. During the beta:

  • No payment is required, and no payment information is collected.
  • Features may be added, changed, or removed without notice.
  • We may limit, suspend, or close beta access at our discretion.
  • If we later introduce paid plans, we will tell you in advance, and you will decide whether to continue.

5. Your Account

You are responsible for the accuracy of the information you provide and for activity that happens through your account. Keep access to your Telegram account and your device secure. Tell us promptly at privacy@eiwa.tech if you believe your account has been accessed without your permission.

6. Your Content and Your Clients' Data

You own the content you store in the Service, including your client records. You grant us a limited license to host and process that content only to provide the Service to you.

With respect to information about your clients, you act as the controller of that data. This means:

  • You decide what client information to collect and store.
  • You are responsible for having the right to store and use it, including any notice or consent your clients may require.
  • Eiwa processes this information on your behalf, only to provide the Service, as described in the Privacy Policy.

7. Messages to Your Clients

The Service sends only transactional messages to your clients, such as appointment reminders and confirmations related to bookings they made with you. The Service does not send marketing messages to your clients without their consent, and you agree not to use the Service to do so.

8. Acceptable Use

Your use of the Service must comply with our Acceptable Use Policy, which is part of these Terms. In short: use the Service lawfully, only for your own business, and do not abuse it or other people.

9. AI-Generated Output

The Service uses artificial intelligence to transcribe your voice, interpret your requests, and generate responses. AI systems can make mistakes, including transcription errors and incorrect suggestions.

  • Review AI-generated output where appropriate before relying on it, especially appointment details and messages sent to clients.
  • You remain in control: the Service acts on your instructions and is not fully autonomous.
  • We do not guarantee that AI output will be accurate, complete, or suitable for any particular purpose.

10. What Eiwa Is Not

Eiwa is not a medical service and does not provide medical advice. Notes you store about clients are your business records, not medical records.

  • Eiwa does not claim compliance with HIPAA, and the Service is not intended for storing protected health information as defined by HIPAA.
  • Eiwa does not guarantee that your use of the Service satisfies any law that applies to your business. You are responsible for your own legal compliance.
  • Eiwa is not a fully autonomous agent. It assists you, and you are responsible for the decisions and communications made through your account.

11. Intellectual Property

The Service, including its software, design, and branding, belongs to Eiwa and its licensors. We grant you a personal, limited, non-exclusive, non-transferable license to use the Service for your own business while these Terms are in effect. You may not copy, modify, resell, or reverse engineer the Service except where the law allows it despite this restriction.

12. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that AI output will be accurate.

13. Limitation of Liability

To the fullest extent permitted by law, Eiwa will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or related to the Service.

To the fullest extent permitted by law, our total liability for all claims related to the Service will not exceed the greater of one hundred US dollars ($100) or the amounts you paid us for the Service in the 12 months before the claim arose. Because the beta is free, that amount is expected to be $100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

14. Termination

You may stop using the Service and delete your account at any time, as described on the Data Deletion page. We may suspend or terminate your access if you violate these Terms, if we discontinue the beta, or where required by law. On termination, your data is handled as described in the Privacy Policy.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by other reasonable means before the changes take effect. Continuing to use the Service after the changes take effect means you accept the updated Terms.

16. Governing Law

These Terms are governed by the laws of the United States and the state identified in the final version of this document. [Governing law and venue to be confirmed by counsel before publication.]
